Enrollment Agreement
Effective Date: July 1st, 2026
Before accessing course materials, all students must read and agree to the following terms and conditions.
By enrolling in this course, accessing course materials, attending classes, participating in live sessions, downloading resources, or using our online learning platform, you agree to comply with this Student Enrollment Agreement and Course Use Policy.
1. Memberships, Payments & Refunds
The school offers Basic, Premium, and VIP membership plans.

Monthly Memberships: Students will have access to the course and membership benefits as long as their monthly payments remain current.

Annual Memberships: Students who purchase an annual Basic, Premium, or VIP membership receive a discounted rate and will have access to the course for twelve (12) months from the date of enrollment.
All membership purchases are final. No refunds, partial refunds, credits, or transfers will be issued for any Basic, Premium, or VIP membership, whether purchased monthly or annually.
2. Intellectual Property & Copyright Protection
All course materials are the exclusive property of Bernard Tech Academy and are protected by United States and international copyright laws.
This includes, but is not limited to:

Course videos and recorded lessons

Live class recordings
-
Workbooks, PDFs, and downloadable resources
-
Exercises, quizzes, and assessments
-
Presentations, slides, and lesson plans
-
Audio recordings
-
Teaching methods and proprietary content
-
School name, logo, trademarks, and branding
-
Website content, graphics, images, icons, and designs
-
Marketing materials and promotional content
Students are granted a limited, revocable, non-transferable license to use these materials for personal educational use only.
Students may NOT:

Copy, reproduce, distribute, sell, share, publish, modify, or otherwise make available any course materials.

Upload course content to websites, social media, YouTube, cloud storage, or file-sharing platforms.

Use, copy, alter, or display the school's name, logo, branding, graphics, images, trademarks, or marketing materials without prior written permission.

Share account login credentials.
-
Record classes without written permission.
-
Use course content or materials to create competing courses, training programs, or educational products.
-
Use artificial intelligence (AI) to reproduce, redistribute, recreate, or generate derivative versions of course materials.
Unauthorized use may result in:

Immediate account suspension or termination
-
Removal from the course without refund
-
Legal action for copyright infringement
-
Recovery of damages, legal fees, and associated costs where permitted by law
3. Student Account Security
Students are responsible for maintaining the confidentiality of their account credentials.
Students agree:

Not to share usernames or passwords.

Not to allow others to access the course through their account.

To notify the school immediately of any unauthorized account access.
Bernard Tech Academy reserves the right to suspend or terminate accounts suspected of unauthorized sharing or fraudulent activity.
4. Privacy & Protection of Student Records
We are committed to protecting student information and educational records.
Student information may include:

Name

Email address

Phone number
-
Mailing address
-
Enrollment information
-
Attendance records
-
Assessment results
-
Academic progress reports
-
Payment records
The school will:

Maintain reasonable administrative, technical, and physical safeguards to protect student information.

Restrict access to student records to authorized personnel only.

Never sell student information to third parties.

Use student information solely for educational, operational, and administrative purposes.
Students may request access to their records by contacting administration.
5. Confidentiality of Student Information
Students agree to respect the privacy of fellow students.
Students may not:

Share another student's personal information.

Publish screenshots containing student information.
-
Record or distribute classroom discussions without permission.
-
Harass, threaten, or misuse information obtained through the course.
Violations may result in disciplinary action or removal from the program.
6. Classroom Conduct Policy
Students are expected to maintain professional and respectful behavior at all times.
The following are prohibited:

Harassment or discrimination

Offensive, abusive, or threatening language
-
Disruptive behavior during classes
-
Bullying or intimidation
-
Sharing inappropriate content
-
Academic dishonesty or cheating
-
Threatening instructors, staff, or students
Bernard Tech Academy reserves the right to remove students who violate these standards.
7. Use of Artificial Intelligence (AI)
Students may use AI tools for learning assistance unless otherwise instructed.
Students may not:

Submit AI-generated work as their own when assignments require original responses.

Use AI to reproduce or redistribute course materials.
-
Use AI to create unauthorized copies of lessons, assessments, or educational resources.
8. Recording Policy
Live classes may be recorded by the school for educational, training, quality assurance, and student review purposes.
Students may not record:

Live classes
-
Teacher presentations
-
Student discussions
-
Course videos
-
Screen shares
Without prior written authorization from Bernard Tech Academy.
All recordings created by the school remain the exclusive property of the school.
9. Refund Policy
All refunds are governed by the school's published refund policy.
The school reserves the right to deny refunds in cases involving:

Violation of course policies
-
Unauthorized content sharing
-
Fraudulent activity
-
Account misuse
-
Removal from the program due to misconduct
10. Course Access Termination
The school may suspend or terminate access without refund for:

Copyright violations
-
Account sharing
-
Harassment or misconduct
-
Unauthorized distribution of content
-
Fraudulent activity
-
Violation of any provision of this Agreement
11. Limitation of Liability
The school provides educational services on a best-effort basis.
The school does not guarantee:
Specific English proficiency outcomes

Employment opportunities
-
Immigration benefits
-
Academic admissions
-
Professional certifications
Student success depends on individual effort, participation, attendance, and study habits.
To the fullest extent permitted by law, the school shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in the course.
12. Consent to Electronic Communications
Students consent to receive:

Course announcements
-
Class reminders
-
Administrative notices
-
Academic progress updates
-
Billing notices
-
Policy updates
Through email, SMS, phone calls, or the learning platform.
13. Non-Disclosure of Course Content
Students agree not to disclose, share, publish, copy, distribute, or otherwise make available any proprietary course materials, teaching methods, lesson plans, assessments, exercises, recordings, or educational strategies without prior written permission from the school.
This obligation survives course completion, withdrawal, and account termination.
14. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of [State], without regard to conflict-of-law principles.
Any disputes arising from this Agreement shall be resolved in the appropriate courts located within the State of [State].
15. Acceptance of Agreement
By checking the box below, I acknowledge that I have read, understood, and agree to this Student Enrollment Agreement. I understand that access to the course will not be granted until this Agreement has been accepted.
